LMIA Work Permit

The following guide is for jobs that require a positive LMIA (Labour Market Impact Assessment) before applying for a Work Permit

 

In general, employers must obtain a Labour Market Impact Assessment (LMIA) prior to hiring foreign workers. To secure a favorable LMIA, a Canadian employer is required to demonstrate that there are no available Canadian citizens or permanent residents qualified to perform the job in question, thus necessitating the employment of a foreign worker.

LMIA applications should show the following:

​

  1. Efforts made to enlist available Canadian citizens/permanent residents.

  2. Wages offered for the position are aligns with the current wage rate offered to Canadians/permanent residents in the same occupation in the region.

  3. Working conditions for the occupation aligns with the prevailing standards of provincial labour market.

LMIA Exempt Work Permit

 Canadian Employers regularly require a favorable LMIA outcome in order to hire temporary foreign workers. There are several     cases, however, where the need for a LMIA may be exempted.

Work without a Permit

An individual who qualifies to work without a work permit may still need to obtain a Temporary Resident Visa or an eTA (Electronic Travel Authorization) to enter Canada on a temporary basis.

In addition, individuals should be ready to provide immigration authorities with documentation that verifies their intended status in Canada .This documentation will differ depending on specific circumstance. Oftenly,  a letter of support from a parent company or an invitation letter form a Canadian firm can significantly enhance an individual’s chances of being accepted into Canada. 

Open Work Permit

An Open Work Permit (OWP) authorizes a foreigner to work in Canada in ANY job, with limitations.  The holder of an OWP does not require having an LMIA or prior employment confirmation.  Once issued an OWP, the holder can apply and engage in any job/occupation in Canada.

Bridging Open Work Permit

The bridging open work permit (BOWP) is a method to ensure that an employee in Canada can continue working while his or her application for permanent residence is being processed.

In-Canada applicants who have made an application to immigrate to Canada under either the Federal Skilled Worker (FSW) Class, the Federal Skilled Trades (FST) Class, the Canadian Experience Class (CEC) or one of the Provincial Nominee Programs (PNP) A  hs. Foreign workers who are legally employed in Canada and have submitted, or are about to submit, an application for permanent residence under one of the designated immigration programs are permitted to continue working until a decision is reached regarding their permanent residence application.

Requirements for Visitor Visa :

  • Have a valid travel document

Who Needs a Visitor Visa?

If you plan to visit Canada, you’ll need a visitor visa, also known as a temporary resident visa (TRV)

Your temporary resident visa allows you to visit and reside in Canada temporarily. You will need a TRV to enter and stay in Canada unless you are from a visa-exempt country.

Student Visa

International students who have completed the application process and obtained acceptance from a Designated Learning Institution (DLI) are qualified to apply for a Canada Student Visa. This visa permits them to enter Canada and engage in the particular program for which they have been admitted. It is essential to obtain an acceptance letter from the designated institution you plan to attend before submitting your application for the Canada student visa. Furthermore, you are required to meet the following criteria to obtain a Canada student visa. You must have been accepted by a Designated Learning Institution (DLI) in Canada

 

   You must prove that you have enough money to pay for your:

  •  Tuition fees

  •  living expenses for yourself and any family members who come with you to Canada and return transportation yourself and any family members who come with you to Canada.

  •     You must be a law-abiding citizen with no criminal record and not be a risk to the security of Canada.

  •     You may have to provide a police certificate.

  •     You must be in good health and willing to complete a medical examination, if necessary.

  •     You must satisfy an immigration officer that you will leave Canada at the end of your authorized stay.

   

   To be eligible for a study permit in Canada, you must meet the following requirements:

  • Have an acceptance letter from a designated learning institution (DLI) in Canada

  • Demonstrate sufficient funds to support your stay in Canada

  • Not be criminally inadmissible

  • Clear a medical examination if required

  • Convince an immigration officer that you intend to leave Canada after your study permit expires

Express Entry

The Canadian Government established the Express Entry system to streamline the Permanent Resident visa application process. This electronic system facilitates online submission resulting in faster processing times.

The following programs are processed by Express Entry:

 Selection - The Canadian government invites to candidates to apply in rounds throughout the year , based on their scores in the   Comprehensive Ranking System ( CRS ).

 Invitations - Successful Candidates receive an invitation letter from the Canadian government. 

​

 Acceptance - If a candidate accepts the invitation and immigration , refugee and citizenship Canada assesses their application   positively, they and their family members will be granted permanent resident status.   â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹â€‹

All Economic Class programs are planned to bring immigrants to Canada who can set up themselves economically in the country.

​

The Federal Skilled Worker program falls under the Economic Class and is administered through the Express Entry system. Estimated processing times are currently 6 months once an Invitation to Apply (ITA) is received.

Program Requirements 

Need professional work experience of at least one continuous year of full-time paid work experience or the equivalent in part-time continuous employment listed in the National Occupational Classification (O, A or B) in the last 10 years. OR Qualify for Arranged Employment In Canada with a full-time, permanent job offer from a Canadian employer along with or without a LMIA

A Canadian diploma, certificate, or credential  AND/OR a foreign educational credential, and an Educational Credential Assessment (ECA) by an agency approved by IRCC to show it is equal to a completed Canadian secondary or post-secondary educational credential.

Meet the minimum language score of CLB 7 on the Canadian Language Benchmark, or equivalent.

Have settlement funds  to support yourself and your family for six months after arrival in Canada.

All Economic Class programs aim to attract immigrants to Canada who can establish themselves economically in the country.

The Federal Skilled Trade Class is part of the Economic Class and this is managed by the Express Entry program. Estimated processing times are currently 6 months once an Invitation to Apply (ITA) is received. 

Federal Skilled Trades Class requirements

  • Duration (accompanied by an LMIA) OR a Certificate of Qualification from a provincial or territorial body

  • Meets the minimum language score of CLB 5 for all of the 4 abilities ( Reading , Writing , Speaking & Listening)

  • Have obtained 24 months of qualified work experience in the skilled trade in the last five years

  • Be qualified to meet the requirements of the job offer(s) or trade in Canada, as defined by the NOC.

There are several occupations are eligible for this program .These eligible occupations fall into the following general categories:

  • Industrial, electrical and construction trades

  • Maintenance and equipment operation trades

  • Supervisors and technical occupations in national resources, agriculture and related production

  • Processing, manufacturing and utilities supervisors and central control operators

  • Chefs and cooks

  • Butchers and bakers​

Canadian Experience Class (CEC)

All Economic Class programs are designed to bring immigrants to Canada who can set up themselves economically in the country.

The Canadian Experience Class is part of the Economic Class and this is managed by the Express Entry program. Estimated processing times are currently 6 months once an Invitation to Apply (ITA) is received.

Canadian Experience Class requirements

  • Have obtained at least one year of full-time skilled, professional or technical work experience in Canada within 36 months of the application date.  Self-Employment or work experience gained while being a full-time student does not count

  • The job experience is in  a Managerial job (NOC skill level 0),  Professional job (NOC skill type A), Technical jobs and skilled trades (NOC skill type B)

  • Meet the minimum language score of CLB 5 or CLB 7 on the Canadian Language Benchmark, depending on the level of the job

Valid option for International Students

The Canadian Experience Class offers students with Canadian work experience the fastest and simplest path to achieving permanent residency whilst qualifying for other immigration programs as well.

​

After completing a program or course of study at a Canadian educational institution, international graduates are able to remain in the country and work on post-graduate work permits. Once a graduate obtains at least one year of Canadian work experience in a skilled, professional or technical field, they may then become eligible to apply under the Canadian Experience Class.

Provincial Nominee Program (PNP)

PNP programs are another option to immigrate to Canada if you do not have enough points to be selected under Express Entry or not eligible for any other immigration category

The Provincial Nominee Programs (PNP) allow Canadian provinces and territories to nominate individuals who wish to immigrate to Canada and who are interested in settling in a particular province.

Each Canadian province (except Quebec, which has a different selection system) and two territories have their own unique Provincial Nominee Programs. Participating provinces and territories sign agreements with IRCC that allow them to select immigrants who meet the requirements that they have set forth.

Provinces with PNP programs each have their own selection criteria to find immigrants with skills that the province needs which they cannot hire locally.  The selection criteria and occupations vary across provinces from information technology, medical, agriculture, trades, business, investors, and people who have ties to Canada.

How does the program work?

Candidates must first be entered into the Express Entry System with their CRS score, then apply to a PNP program (which is a separate application). You will remain in the Express Entry pool for a year, or until you are selected to apply for Permanent Residence.

​

You will be granted additional 600 points to add to your Express Entry score if you receive a nomination. With these additional 600 points, you will be selected and invited to apply for PR at the very next draw, which occurs frequently.
